The Court of Instruction 1 of Motril (Granada) has filed the complaint for a possible crime of incitement to hatred filed by the Prosecutor's Office against a neighbor of this town who used Twitter to post comments against deputies Gabriel Rufián and Pablo Iglesias, among others.
According to sources of the Public Prosecutor's Office, the investigating court in charge of the case has decided to close the complaint, a decision against which the Prosecutor's Office will present an appeal.
Appeal of the Office of the Prosecutor 
The Prosecutor's Office proposed in its complaint that the accused user be received as investigated and that the members of Podemos Pablo Iglesias, Íñigo Errejón and Carolina Bescansa beharmed .
According to his letter , the facts have the character of a crime of incitement to hate and not only would have been harmed certain representatives of political parties because of their opinions and public positions, but also another person because of their homosexual status, gypsy and foreign ethnicity.
The messages, mostly issued in October 2016, had some diffusion among other users, as they accredit access and forwarding data, which entailed the endangerment of legal assets, with possible adverse reactions and followers of the line marked by the accused.
The messages 
Among the publications on Twitter that the prosecutor gathers in his complaint is the one that gave rise to the investigation and that took place on October 4, 2016against the ERC spokesperson at the Gabriel Rufián Congress , with a threatening message on his public profile in which he wished the death of his son ("I hope they kill him," he said literally).
Other disseminated tweets in which the police detected content "inciting violence and hatred"were sent to Oriol Junqueras, Muriel Casals, Raul Romeva, Carme Forcadell or Artur Mas. 
To these he said: "all to the prison or to the wall . "

Pablo Iglesias and the deputies of the purple formation Carolina Bescansa or Íñigo Errejón , were also targets of the insulting messages. 
That is why the prosecutor proposed that a statement be received as injured to all three. 
Errejón, for example, allegedly told him: "I'm going to throw lye in your mouth" in a tweet that, according to the complaint, was published on April 15 of last year.
Report filed 
At the start date of the investigation by the Catalan Judicial Police, the tweets and the account of origin had been suspended from activity by the operating company.
As published by the  Ideal of Granada , the complaint now filed and that will be appealed was formalized on October 5 and had been formulated by the Criminal Protection Service of Equality against Hate and Discrimination of the Provincial Prosecutor's Office of Granada.
