En un comunicado publicado en el diario ‘La Razón’, el líder de la organización criminal conocida como Partido Popular, Mariano Rajoy, apodado “el Deretxoki”, ha confirmado que la banda continuará adelante con su actividad de saqueo de dinero público.

A pesar de la persecución judicial a la que se ven sometidos, los delincuentes se han negado a entregar los sobres y tampoco se han mostrado dispuestos a pactar ningún tipo de tregua.

En colaboración con la policía suiza, los agentes españoles han localizado diversos zulos del PP en Madrid y han detenido a dirigentes históricos como Ignacio González, alias “Aguirrito”, o incluso a Manuel Moix, un fiscal Anticorrupción al que la banda tenía comprado.

"No cederemos en nuestra actividad. No servirá que paren las detenciones ni que acerquéis los presos peperos a su casa:

La banda sabe que cuenta con un grandísimo apoyo por parte del pueblo. Además, no reconoce la legitimidad de los tribunales que les acusan. Solo reconocen la legitimidad de los jueces que ellos han puesto a dedo.

Según la Convención de Palermo del año 2000: Una organización criminal es un grupo estructurado de dos o más personas que existe durante cierto tiempo y que actúa concertadamente con el propósito de cometer uno o más delitos tipificados.

Si analizamos esta definición podemos concluir que el Partido Popular es una organización criminal. 

En primer lugar porque es un grupo estructurado, con una jerarquía definida, sin duda nadie puede negar ya, que muchos de sus miembros han cometido delitos graves, claramente tipificados en el código penal, que los implicados son más de dos y que los han durante los últimos veinte años.

No se por qué exageramos. Si, total, sólo son 900 "casos aislados" (bueno, los que han salido a la luz)

Por lo tanto debemos llamar a las cosas por su nombre, basta ya de eufemismos inútiles que tratan de esconder la verdad.

Una organización donde se ha generado constantes delitos con tramas tan importantes como:

El caso Bárcenas, la trama Gürtel, la trama Púnica, la trama Lezo, la trama del dinero negro utilizado como pago corriente y las otras tramas que han sido descubiertas, los últimos años, en Baleares, Valencia, Murcia y Madrid no deja lugar a ninguna duda.

El Partido Popular es una banda criminal

Si a todo ello añadimos que en ellas han participado además de los políticos peperos, empresarios, y que en algunos casos se han implicado, presuntamente, miembros del gobierno y del estamento judicial para beneficiarias, podemos concluir que estamos ante una organización más cercana al término mafia que a la de simple delincuencia.

Una organización (el PP) que tiene cerca de 900 imputados (entre ellos todos sus tesoreros nacionales de las últimas décadas), cuyos delitos cubren gran parte del territorio español, que ha ganado elecciones con presupuestos inflados de forma ilegal y que ha ocultado y defendido a los presuntos delincuentes hasta el límite máximo, es más que un partido político, es una banda criminal.

El caso de la operación Lezo es un claro ejemplo. Apenas empezado a investigar, ha dejado claro que, presuntamente, el capo de la mima –Ignacio González, hoy en la cárcel- se ha valido del gobierno, donde dos ministerios están directamente implicados –presuntamente-, Interior y Justicia, además del Fiscal General del Estado y del Fiscal Anticorrupción, con el fin de conocer pormenores de su caso y presionar para evitar que avanzara.

La cosa viene de antiguo

Entre todas las tramas de corrupción descubiertas –sin contar las que puedan surgir en adelante - nos han estafado cerca de 90.000 millones de euros al año (cifra avalada por la Cámara Nacional de Mercados y Competencia y varias universidades). 

Una cifra superior a todos los recortes que hemos sufrido en los últimos años. A cada español, la corrupción le cuesta 500 euros al año. No es ninguna broma.

Es hora de que paguen los traidores y devuelvan el dinero. 

Por cierto los traidores no son los que quieren hacer un referéndum en Cataluña, ni los que se manifiestan y rodean el Congreso. 

Tampoco lo son los que hacen huelgas para defenderse. 

Los traidores tienen nombre y apellidos y muchos están o estaban (cuando han cometido el delito, los echan o se van) en el Partido Popular. 

Eso sí, avalados por millones de españoles que, a sabiendas, votan a los corruptos y se convierten en sus acólitos, y en cómplices morales de sus delitos.

El elemento fundamental de la criminalidad organizada es la existencia de una organización criminal. Sunota definitoria no viene determinada tanto por la concurrencia de una pluralidad de personas o por los delitos que cometen, sino por la forma en que dichas personas están estructuradas y por cómo realizan dicha actividad delictiva. Así, como características esenciales de la criminalidad organizada, podemos apuntar las siguientes ( 1 ):

1º- La existencia de unos objetivos comunes. El fin u objetivo último, suele ser la obtención de lucro ilícito, para cuya consecución se valen de otros fines mediatos como puede ser la protección de sus miembros, las alianzas con otros grupos o la consecución de grados de poder.

2º.- La división de funciones que conduce a una profesionalización o especialización de sus miembros o subsistemas y a la mayor eficacia de la organización.

3º.- La estructura, que comporta un ensamblaje de la organización, vertical o jerárquico u horizontal, con una serie de normas o códigos de actuación o de conducta, que son asumidos por el grupo y que dota a la misma de una permanencia que le permite la coordinación de las actividades para la consecución de su objetivo.

4º.- Un sistema de toma de decisiones, generalmente jerárquico, bien centralizado, bien reticular, en el que coexisten subsistemas con estructuras flexibles y con autonomía en la toma de decisiones en relación con el sistema superior.

5º.- Cohesión entre sus miembros, basado en el interés de conseguir sus objetivos, o determinado por un componente ideológico o étnico.

6º.- Relaciones con el medio exterior, bien utilizando o aprovechándose de la violencia para sus fines, bien valiéndose de las debilidades del sistema para aprovecharse de las fisuras de las relaciones económicas o sociales ordinarias.

7º.- Tendencia a la autoconservación por encima de la renovación de sus miembros, y donde la capacidad de permanencia es mayor cuanto más compleja sea la organización en tanto que puedan seguir manteniéndose sus objetivos.


La primera vez que las Naciones Unidas se ocupa del fenómeno de la criminalidad organizada, y por tanto reconoce su existencia y el daño que produce es en el año 1975, en la "V Convención de las Naciones Unidas para la Prevención del Crimen", distinguiendo entre criminalidad organizada, criminalidad de empresa y corrupción, pero no fue hasta la "Convención de las Naciones Unidas contra la Delincuencia Organizada Transnacional de 15-11-2000" -EDL 2000/102014- ( 2 ), cuando se definieron a tales efectos los conceptos de "grupo delictivo organizado" y de "grupo estructurado", los cuales pueden entenderse como antecedentes de los concepto de organizaciones y grupos criminales que utiliza nuestro legislador.

El art. 2 de esta Convención -EDL 2000/102014- entiende a los efectos de la misma, como:

"grupo delictivo organizado" a "un grupo estructurado de tres o más personas que exista durante cierto tiempo y que actúe concertadamente con el propósito de cometer uno o más delitos graves o tipificados con arreglo a la presente Convención con miras a obtener, directa o indirectamente, un beneficio económico u otro beneficio de orden material";

"delito grave", "la conducta que constituya un delito punible de privación de libertad máxima de al menos cuatro años o con una pena más grave";

"grupo estructurado", un grupo no formado fortuitamente para la comisión inmediata de un delito y en el que no necesariamente se haya asignado a sus miembros funciones formalmente definidas ni haya continuidad en la condición de miembro o exista una estructura desarrollada

Further, in the process of liberalization of the sector it is announced for 2020 we fear that  private operators will keep the benefit of profitable lines  while  the state is left with the debt involved the construction of infrastructure. 

To make matters worse,  we find that 

we may have to pay as ransom the surreal adventures of certain projects led by Spanish companies, as the almost certain frustrated construction of TAV between Mecca and Medina.

Ultimately we can qualify the AVE as an instrument of class power. It is built by poor, with money from the poor  to benefit the business and political elites; and above  only use the rich because the ticket price is prohibitive for the popular classes, which also will be taxed through taxes to fund its maintenance,  while the conventional train used by the poor  is  doomed  to more of dropouts. 

Finally,  the TAV  as has been clearly demonstrated in the recent study of Ekopol,  at all can be justified as aguarantee of energy savings and reducing emissions of greenhouse gases, but quite the opposite.
