Tens les teves creences, altres tenen les seves. Pots debatre tot el dia, encara no hi ha resolució per als ideals en conflicte i això és perfectament bé  (Somrient) El que se sent veritable i just per al cor sempre serà diferent de persona a persona. És important recordar mantenir el respecte a l'equació. Pot ser que no estigui d'acord amb un punt en particular, però  escoltar i comprendre  és la clau.  Això  és respecte! Permetre-mantenir les seves creences, sigui el que sigui que sigui, i deixar que altres tinguin les seves és fonamental en la comunicació. Si no estàs escoltant, no t'estàs comunicant. ~ Creador

Tienes tus creencias, otras tienen las suyas. Puedes debatir todo el día, todavía no hay resolución para los ideales en conflicto y eso es perfectamente bien (Sonriendo) Lo que se siente verdadero y justo para el corazón siempre será diferente de persona a persona. Es importante recordar mantener el respeto en la ecuación. Puede que no esté de acuerdo con un punto en particular, pero escuchar y comprender es la clave.  Esto es respeto! Permitirle mantener sus creencias, sea lo que sea que sea, y dejar que otros tengan las suyas es fundamental en la comunicación. Si no estás escuchando, no te estás comunicando. ~ Creador

A thought to ponder today…

You have your beliefs, others have theirs.  You can debate all day long, there still may be no resolution to conflicting ideals and that is perfectly okay. (Smiling) What feels true and just to the heart will always differ from person to person.  It is important to remember to keep respect in the equation.  You may not agree on a particular point but listening and understanding is key.  This is respect!  Allowing yourself to maintain your beliefs, whatever they may be, and letting others have theirs is fundamental in communication.  If you are not hearing, you are not communicating. ~ Creator

The hot potato is in the hands of the Supreme. The association "Atenes juristes pels drets civils" denounced the president of the Supreme Court and the General Council of the Judiciary, Carlos Lesmes more than 20 judges of the High Court and the High Court for prevarication. As argued in the complaint judicial appointments dome rigged the certain magistrates and judges in key positions directly related to pore causes corruption affecting the Popular Party. These appointments, according to the complaint, had only intended to put "friends judges" for the benefit of this political formation on multiple fronts investigated for corruption.

The complaint, signed by former Judge Jose Elpidio Silva adds that "this complaint is formulated in view of the finding of a plan perfectly designed by the defendants who, taking advantage of manipulation and systematic abuse of discretion provided for the appointment of professionals called upon to occupy certain judicial bodies, proposed and approved coverage of the most sensitive organs of the judicial pyramid with members of the legal profession selected by their profile and their ideological position, ensuring that the persons proposed with this criterion players to adopt the office of the desired causes. "

The complaint cites various causes linked to the Gürtel plot and lists those suspects one to one appointments. 

For example the "Conception Espejel as President of the Second Section of the Criminal Division of the High Court, modifying the composition criteria of the Courts of Second Section and self - attribution by the defendant of the Presidency of the Courts charge the prosecution of proceedings against the Popular Party. " 

The complaint also cites as a suspect the appointment of Judge Don Juan Pablo González "as a member - and rapporteur of the courts responsible for prosecuting four cases that directly affect the Popular Party."

The complaint lists the objective data and relationships that link these two judges with the organizational and ideological structure of the Popular Party. 

Manipulation of judges and rooms

La patata calenta està en mans del Suprem. L'associació "Atenes juristes pèls drets civils" ha denunciat el president del Tribunal Suprem i del Consell General del Poder Judicial, Carlos Lesmes ja més de 20 magistrats de l'alt tribunal i de l'Audiència Nacional per prevaricació. Segons s'argumenta en la querella la cúpula judicial Amano el nomenaments de determinats magistrats i magistrades en llocs clau directament relacionats amb causes porus corrupció que afectaven el Partit Popular. Aquests nomenaments, segons la denúncia, només tenien per objecte col·locar a "jutges amics" per a benefici d'aquesta formació política investigada en múltiples fronts per corrupció. 

Ja ho va avisar el GRECO

La querella fa múltiples referència a les recomanacions i denúncies del GRECO (grup de països contra la corrupció vinculat a Nacions Unides), sobre "la manca de reglamentació dels criteris objectius i requisits d'avaluació per al nomenament d'alts càrrecs en la judicatura possibilita, precisament, el que aquí es denuncia, és a dir, que concrets nomenaments s'efectuïn com a conseqüència de la vinculació política dels jutges i magistrats i no dels mèrits i aptituds jurídiques dels mateixos ". 



Beneficiar el PP

La querella, signada per l'ex magistrat José Elpidio Silva afegeix que "la present querella es formula en atenció a la constatació d'un pla perfectament dissenyat pels querellats qui, prevalent-se de la manipulació i l'abús sistemàtic de la discrecionalitat prevista per a la designació de els professionals cridats a ocupar determinats òrgans judicials, van proposar i van aprovar la cobertura dels òrgans més sensibles de la piràmide jurisdiccional amb membres de la carrera judicial seleccionats pel seu perfil i pel seu posicionament ideològic, assegurant que les persones proposades per tal criteri assumissin el despatx de les causes desitjades ". 

Amb noms i cognoms

La querella cita les diverses causa vinculades amb les trama Gürtel i enumera 1-1 aquests nomenaments sospitosos. 

Per exemple el de "Concepció Espejel com a Presidenta de la Secció Segona de la sala penal de l'Audiència Nacional, modificació dels criteris de composició dels Tribunals de la Secció Segona i acte atribució per la querellada de la Presidència dels Tribunals encarregats l'enjudiciament de procediments seguits contra el Partit Popular ". 

La querella també cita com a sospitós el nomenament del magistrat Don Joan Pau González "com a membre - i ponent- dels Tribunals encarregats d'enjudiciar quatre causes que afecten directament al Partit Popular".

La denúncia enumera les dades i relacions objectives que vinculen a aquests dos jutges amb l'estructura organitzativa i ideològica del Partit Popular. 

Manipulació de jutges i sales 

També es fa referència, entre altres, a la injusta constitució de sales d'enjudiciament i apel·lació: "Es rescaten el 2017 les Sales d'Apel·lacions de l'Audiència Nacional creades el 2003 però mai formades, i s'atribueixen les mateixes a D. Enrique López (de coneguda vinculació i afinitat al Partit Popular) i al Sr. Eloy Velasco (conegut detractor del Partit Popular i que haurà d'inhibir d'ofici de conèixer sobre els eventuals recursos d'apel·lació interposats contra Lezo i Púnica) ". 


El magistrat instructor que analitzarà aquesta controvertida denúncia és el jutge Antonio del Moral García que ha imposat com a qüestió prèvia a l'Associació denunciant una fiança de 12 mil euros. L'associació "Atenes juristes pèls drets civils" ja ha dipositat aquests diners. 

Tots els ulls pendents d'aquest magistrat del Suprem i de si, contra pronòstic, iniciarà una línia d'indagació referent a les severes acusacions recollides en la querella.
