Since last year,  Deutsche Bank and Nomura  are being investigated  by disguise and distort  the accounts of  Banca Monte dei Paschi between 2008 and 2012,  in which the Italian company appealed to the market  on several occasions to strengthen capital. 

A new line of investigation opened by the Milan prosecutor  accused the German company of "international criminal organization"  by manipulating international indices for complex assets conceal losses Italian bank.

Manipulation of accounts

Giuseppe Iannaccone, a lawyer for Deutsche Bank  and some of the defendants tried that new evidence should be dismissed arguing that there was no clear relationship between market manipulation and alleged aggravating circumstances. 

According to a lawyer specializing in financial crimes,  Giampiero Biancolella,  if the judge admits the aggravating penalties can amount to a maximum of nine years.

Deutsche Bank and Nomura  are accused of using derivative transactions to hide losses in the Italian lender,  which led to makeup accounts between 2008 and 2012. Subsequently  Monte Paschi  had to inspect their accounts and increase capital twice.

Tests

The aggravating international criminal organization depends on the performance of Deutsche Bank  in other parts of the world to manipulate the indexes  that were linked derivatives.

Desde el año pasado, Deutsche Bank y Nomura están siendo investigados por maquillar y falsear las cuentas de Banca Monte dei Paschi entre 2008 y 2012, en las que la entidad italiana apeló al mercado en varias ocasiones para reforzar capital. 

Una nueva línea de investigación abierta por la Fiscalía de Milán acusa a la entidad alemana de "organización criminal internacional" por manipular índices internacionales para que complejos activos ocultaran las pérdidas del banco italiano.

Los fiscales han utilizado documentos y correos electrónicos internos de Deutsche Bank para demostrar "circunstancias agravantes" en la causa que imputa al banco alemán de falsear las cuentas de Banca Monte dei Paschi, según informa Bloomberg. 

Las nuevas pruebas aportadas incluyen mensajes entre operadores de derivados de Londres con uno de los investigados en el juicio.

La nueva documentación sobre supuesta manipulación del mercado que opera desde varios países podría dar lugar a penas más altas si hay sentencia firme contra los acusados. 

En el llamado caso Santorini están siendo juzgados seis banqueros de Deutsche Bank y la propia entidad por ayudar a falsear las cuentas de Monte dei Paschi. 

En total están siendo procesados trece ex directivos entre el banco alemán, el japonés y el italiano.

Manipulación de las cuentas

Giuseppe Iannaccone, abogado de Deutsche Bank y algunos de los acusados, intentó que se desestimaran las nuevas pruebas argumentando que no había una clara relación entre la manipulación del mercado y las supuestas circunstancias agravantes. 

Según un abogado especializado en delitos financieros, Giampiero Biancolella, si el juez admite el agravante las penas pueden ascender a un máximo de nueve años.

Deutsche Bank y Nomura están acusados de usar operaciones de derivados para ocultar las pérdidas en el prestamista italiano, lo que llevó a maquillaje de la cuentas entre 2008 y 2012. Posteriormente Monte Paschi tuvo que revisar sus cuentas y ampliar capital en dos ocasiones.

Pruebas

El agravante de organización criminal internacional depende de la actuación de Deutsche Bank en otros partes del mundo para manipular los índices a los que estaban vinculados los derivados. 

Una investigación de la Autoridad Federal de Supervisión Financiera de Alemania (BaFin, por sus siglas en alemán) en 2014 reveló que los empleados del banco habían manipulado los índices internos para ayudar a asegurar una ampliación de capital en 2008. 

El documento que está siendo utilizado en el actual juicio señala que "las actividades comerciales del Deutsche Bank fueron un factor determinante para establecer los precio y volumen" de la operación.

Un operador del propio banco en Londres felicitó por correo electrónico a Michele Foresti, exjefe de renta fija europea de Deutsche, por cerrarse la operación. 

Si bien los investigadores no pueden demostrar la manipulación de los índices con el resultado de la operación, según la auditoría encargada por BaFin, las comunicaciones entre los empleados "proporcionan una conexión entre la actividad comercial de de Deutsche Bank con la ampliación de Monte dei Paschi", argumenta la fiscalía

Aunque es posible que la expropiación de El Prat necesitara del visto bueno del Consejo de Ministros... Algo imposible pero que cargaría de razón a la Generalitat a la hora de reclamar la independencia de Catalunya y el control de sus infraestructuras para la sociedad.
